Common questions
What if they don't pay after getting the letter?
You can take them to small claims court (up to AUD $10,000 in most states). The letter of demand proves you tried to resolve it first.
How should I send it?
Registered mail, email (with read receipt), or hand-delivered. Keep proof of sending. Allow 7-14 days for response.
Can I charge interest?
Only if they agreed to it (in writing or by contract). Otherwise, you can claim interest from the court. Interest is usually around 10% p.a.
What if I'm the one getting the letter?
Don't ignore it. Pay if you owe the money, or contact the sender to negotiate. Ignoring it makes legal action more likely.
